‘Business as usual’ for Ballybay Mart after High Court appearance

Ballybay Mart’s operating licence is no longer suspended.

The High Court lifted the temporary suspension at yesterday’s (Tuesday, November 23rd, 2021) hearing.

The mart must agree to a “number of conditions” the PRSA puts forward “to protect current and potential clients”.

The court was told that the Co Monaghan-based mart has debts of approximately €480,000-€490,000.

As That’s Farming reported, the PRSA (Property Services Regulatory Authority temporarily suspended Ballybay Mart’s licence on November 16th, 2021.

The mart was due to hold its weekly sheep sale at 6:30 pm on Tuesday, November 16th.

In a statement to That’s Farming, this morning (Wednesday, November 24th, 2021), a spokesperson for the PRSA said:

“The Authority can confirm that on Tuesday, November 16th, 2021, pursuant to Section 64(4) of the Property Services (Regulation) Act 2011, it made an application on an ex-parte basis to the High Court for an interim order to suspend the licence of Corcaghan Co-operative Agriculture & Dairy Society Limited trading as Ballybay Livestock Sales.”

“The High Court granted this application, which suspended Ballybay Mart’s licence until November 23rd, 2021, at which time, both parties would appear before the court for further consideration.

“At the subsequent hearing of November 23rd, 2021, President of the High Court Ms Justice Mary Irvine, granted Ballybay Mart’s application to have the licence suspension lifted, provided the mart agreed to a number of conditions put forward by the PSRA in order to protect current and potential clients of the mart.”

“Accordingly, while Ballybay Mart’s licence is no longer suspended, it is subject to the oversight of High Court by reason of certain undertakings voluntarily given to the court.”

The matter was adjourned to December 14th, 2021, for mention.

Sales resume 

Furthermore, in a statement on social media, a spokesperson for Ballybay Livestock Sales said:

“We are happy to announce that we are back trading business as usual. “

“Ballybay Mart is licensed to resume trading as normal. We thank our loyal customers for their patience and understanding and look forward to welcoming you all back.”

The mart will hold the following sales

  • Weanling and suckler sale: Friday, November 26th at 6:30pm;
  • General cattle sale of bullocks, heifers, calves and stock bulls: Saturday, November 27th, 2021 at 10:30am;
  • Sheep sale: Tuesday, November 30th, 2021 at 6:30pm.
